IMPORTANT — PLEASE READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you and PIE Inc. for the use of the PIE mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not download or use the App.
1. Grant of License
Subject to your compliance with this EULA and PIE's Terms of Service, PIE grants you a limited, non-exclusive, non-transferable, revocable license to download and install one copy of the App on a mobile device that you own or control, and to use the App solely for your personal, non-commercial purposes.
2. License Restrictions
You agree that you will NOT:
- Copy, modify, or create derivative works of the App or any part thereof
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law
- Remove, alter, or obscure any proprietary notices on the App
- Use the App for any commercial purpose without PIE's prior written consent
- Transfer the App or this EULA to any third party
- Use any automated means, including bots or scripts, to access or interact with the App
- Attempt to gain unauthorised access to any portion of the App or connected systems
- Use the App to transmit malware, viruses, or other harmful code
3. Intellectual Property
The App and all content, features, and functionality thereof — including the PIE name, the PIE pie-motif logo, software, text, images, and design — are owned by PIE Inc. and protected by Canadian, United States, and international intellectual property laws. This EULA does not convey ownership interest in the App. All rights not expressly granted are reserved by PIE.
4. App Store Terms
4.1 Apple App Store
- This EULA is between you and PIE only — Apple is not a party and is not responsible for the App
- PIE, not Apple, is solely responsible for the App and its content
- Apple has no obligation to provide maintenance or support services for the App
- In the event of App failure to conform to any applicable warranty, you may notify Apple for a refund; Apple has no other warranty obligation
- Apple is not responsible for addressing any claims relating to the App or your use of it
- If a third party claims the App infringes their intellectual property rights, PIE is solely responsible for the investigation, defence, and settlement of such claim
- Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary
4.2 Google Play Store
- This EULA is between you and PIE only — Google LLC is not a party and is not responsible for the App
- PIE, not Google, is solely responsible for the App and for providing maintenance and support
- Google has no obligation or liability to you with respect to the App or this EULA
- Google is a third-party beneficiary of this EULA and has the right to enforce it
5. Updates and Maintenance
PIE may develop and provide App updates which may be automatically installed or require manual action. You agree to promptly install all updates and acknowledge that the App may not function properly if you fail to do so. PIE is not obligated to provide any updates or continue supporting any particular App version.
6. Third-Party Services and Content
The App may display third-party content or provide links to third-party websites including affiliate network links, social media platforms, and merchant websites. PIE is not responsible for any third-party content, services, or websites accessed through the App. Affiliate links redirect to third-party merchant websites for which PIE is not responsible.
7. Data Collection and Privacy
The App collects certain data to operate its features, including affiliate tracking parameters, cashback calculations, quest completion verification, and analytics. All data collection is described in PIE's Privacy Policy and Cookie Policy, which are incorporated into this EULA by reference. You may withdraw consent by deleting the App and submitting a data deletion request at pieapp.io/data-request.
8. Location and Device Permissions
The App may request access to:
- Notifications: To alert you about cashback credits, quest completions, and influencer activity
- Camera and Photo Library: For profile photos or verification images for quest completion
- Internet Access: Required for all core Platform functionality
You can revoke permissions at any time through your device settings, though doing so may limit App functionality. PIE does not request location access.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS WITHOUT WARRANTY OF ANY KIND. PIE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PIE DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PIE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP. PIE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS UNDER THIS EULA SHALL NOT EXCEED FIFTY US DOLLARS (USD $50.00).
11. Indemnification
You agree to defend, indemnify, and hold harmless PIE Inc. and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, and fees (including reasonable legal fees) arising out of or relating to your violation of this EULA or your use of the App.
12. Term and Termination
This EULA is effective from the date you first download or use the App. PIE may terminate this EULA at any time without notice if you fail to comply with any of its terms. Upon termination, you must stop using the App and delete all copies from your device. Sections 3, 9, 10, 11, and 13 survive termination.
13. Governing Law
This EULA is governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any legal proceedings shall be instituted in the courts of Ontario, Canada, and you consent to personal jurisdiction in those courts.
14. Miscellaneous
- Entire Agreement: This EULA, together with PIE's Terms of Service and Privacy Policy, constitutes the entire agreement regarding the App
- Severability: If any provision is held invalid, remaining provisions continue in full force
- Waiver: PIE's failure to enforce any right is not a waiver of that right
- Assignment: You may not assign this EULA without PIE's prior written consent
- Updates to EULA: PIE may update this EULA at any time. Continued use after changes constitutes acceptance
